Booking conditions
Dear Sirs,
For your comfort and safety we recommend detailed recognition of the Booking Conditions. Recognition and consent to these while booking will allow you booking, and the Operator may accept it for realization
- DEFINITIONS AND NOIONS THE BOOKING CONDITIONS
- ORDER - electronic document is the only possible method of booking in www.MorePoland.pl system
- BOOKING - order accepted for realization and confirmed by the Operator
- CLIENT - physical or legal person capable of legal actions in the meaning of the Civil Code, making use of the Operator services.
- OPERATOR - CREATIVE INTELLIGENCE (owner of www.MorePoland.pl), 18/12 Koźmińska str., 00-435 Warsaw, listed with in the economic registry run by the President of the City of Warsaw under number 426918, REGON 356710600, NIP 679-109-71-85
- SUBJECT OF THE CONTRACT
- The subject of the Contract is determination of conditions upon which the Operator renders booking services - rooms, cars, and other tourist services for and on behalf of the Client.
- Rooms are booked via electronic booking system available at www.MorePoland.pl.
- SERVICE BOOKING
- Rooms or other tourist services are purchased by filling in and sending the Order.
- The Client is obliged to properly fill in the Order, while the Operator does not bear any responsibility for the incorrectly filled-in form.
- PRICES
- Prices given at www.MorePoland.pl apply to room, apartment, or one bed per night. Prices include VAT as per booking date.
- Prices in the system can be changed with no reasons given; the Operator confirms that the price given to the Client at the service purchase (booking), after the booking is confirmed, is the actual price to be paid for the service. No extra payment is charged for the booking.
- PAYMENT - CREDIT CARD
- Currency valid at www.MorePoland.pl is Polish Zloty (PLN). Prices given in other currencies (EUR, USD, GBP) are approximate only, at the average exchange rate as per the booking date
- Any difference between the payment done in the ordering process and the final charge, result only and entirely from difference in rates of transactions at the credit card authorization centre or Client's bank.
- Value of services calculated at the ordering process is automatically authorized after the Client fills in required data via eCard - card authorization centre, with the use of coded 128-bits connection.
- The required amount calculated in the form, reserved on the credit card, will be charged within 7 days following the booking date, no later than 2 working days before the Client starts the use of service booked. In case the booking is done later than 2 days before the intended service begins, the reserved amount will be charged directly after the booking is confirmed.
- In the case when the amount cannot be reserved on the credit card for the booking purposes within the above-given date, the booking is ineffective.
- Payment for services not included in the order (e.g., additional nights, paid TV, or hotel mini-bar) must be settled on the spot.
- BOOKING CONFIRMATION
- www.MorePoland.pl system offers services confirmed automatically upon the service booked for the Client as well as services requiring individual confirmation by the Operator.
- In case the service requires confirmation by the Operator, this confirmation is sent within 2 working days to the e-mail address given in the form.
- Confirmation includes booking details or information about beds available in the required dates. After receipt of the confirmation, the booking is considered completed.
- CANCELLATION
- Booking cancellation is related with the following charges:
- 50 PLN - in case the booking is cancelled max. 3 days before the first day the Client intends to start the use of booked stay or other services;
- 100% of the total booking cost in case of cancellation less than 3 days before the first day booked (in case of night - 100% of the price of the first day of stay);
- 100% of the total booking cost in case the Client withdraws from the booking but does not cancel the booking via cancellation form;
- 100% of the total booking cost in case the Client does not arrive or uses the service within the booked dates, with no prior changes.
- In case the booking is cancelled, the money due is returned via bank transfer to the account given by the Client in the cancellation form.
- Booking cancellation is related with the following charges:
- OPERATOR'S RESPONSIBILITY
- The Operator shall take every effort to ensure the data given in the system reflects the reality. Validity of information depends also on hotels cooperating with the Operator, on which the latter has no direct influence.
- In case realization of the original booking is impossible, the Operator shall inform the Client and propose the offer most similar in respect of both standard and price to the service originally booked by the Client, within dates given in the Order form. The Client may resign from the alternative offer - in such case the Operator shall return 100% of the costs incurred by the Client.
- Full responsibility of the Operator cannot exceed the value of services ordered by the Client.
- Return of costs resulting from impossibility of service realization as mentioned above, fulfils any Client's claims for unrealized service.
- DISCLAIMER
- The Operator is not the owner of Hotels presented at www.MorePoland.pl, therefore:
- The Operator is not liable for any damages caused by the Hotel personnel.
- The Operator is not responsible for data given to www.MorePoland.pl by the Hotel, different from the actual.
- The Operator is not responsible for any damages caused by lack of free rooms, in case the Hotel sells more beds than they owe.
- The Operator is not responsible for any inconvenience or discomfort in the Hotel or any other booked place, resulting from e.g., maintenance or repairs of the heating system, temporary switch-off of the entertainment devices (e.g., swimming pool maintenance), water, power or air-conditioning failure, etc.
- 1.In case of "force majeure" not depending on any party, such as e.g., explosion, flooding, fire, strike, risk or outbreak of war, martial law, sabotage, epidemics or other exceptional situation precluding realization of the services according to the agreement, the Operator is released from their obligations and bears no responsibility for unrealized agreement.
- The Operator is not the owner of Hotels presented at www.MorePoland.pl, therefore:
- COMPLAINTS
- Any complaints re. stay in the Hotel should be addressed to the Hotel during the stay as well as sent to the Operator within 48 hrs following the service completion.
- Lack of information re. any problems the Client met during their stay in the Hotel, given to the Operator within the determined date, can seriously affect the efficiency of complaint settlement.
- The Operator declares to settle every complaint within 21 days following its receipt.
- INFORMATION ABOUT THE CLIENT
- Booking via internet page of www.MorePoland.pl the Client consents to their personal data to be included in the Net Travel database at www.MorePoland.pl as well as Polish Travel Quo Vadis responsible for the booking process. Data will be processed only for booking realization purposes as well as facilitating further booking, and for marketing purposes, according to the personal data regulations - act of law dd. 29-08-1997.
- The Client is entitled to update their personal data.
- CONSENT TO THE BOOKING CONDITIONS
Confirming that they accept the booking conditions, the Client, placing an order in the Operator's system, confirms they became familiar with the "Booking Conditions" and are aware of the consequences of such conditions. - FINAL SETTLEMENTS
- Booking Conditions are prepared upon and according to Polish Law. Any claims should be laid to, and are subject to courts appropriate for headquarters of the Operator.
- In the case of any of the conditions becoming invalid, the remaining items of the Booking Conditions remain unchanged.
- The Operator reserves the right to amend the Booking Conditions.
